Biography

Francisco “Cisco” Cabada is a partner at the law firm of Cabada & Hameed LLP. Mr. Cabada’s practice encompasses labor and employment matters and general business and commercial disputes. Mr. Cabada has over a decade of experience in the settlement of disputes between parties and, when a trial is necessary, an exceedingly strong track record for successful litigation in both federal and state courts.

Prior to the formation of Cabada & Hameed LLP, Mr. Cabada was a senior level associate with the international law firm White & Case LLP. While there, he played an integral role in defending companies in employment litigation and in business litigation matters involving issues arising under multiple areas of law, including real estate, personal injury, unfair competition, trade secret, partnership, class action, and general contract disputes. Mr. Cabada also has extensive experience in conducting investigations into employee and managerial misconduct.

Mr. Cabada is fluent in Spanish and well versed in handling employment and business disputes in his native tongue. As an extension of his Mexican heritage, Mr. Cabada has strong ties to the Latino community and is a member of numerous business and community organizations, including the Hispanic Bar Association and the Latino Professional Network.

After several years of honing his litigation skills at White & Case, Mr. Cabada joined the law firm Littler Mendelson P.C. in Orange County California in search of a more localized firm experience. While there, he became reacquainted with his former White and Case colleague Sayema Hameed and they agreed to apply their shared vision for a law firm to the partnership that is now Cabada & Hameed LLP.

Mr. Cabada earned his J.D. from Loyola Law School in 2001, where he graduated near the top of his class and served as a Board Member of the Scot Honors Moot Court team. While at Loyola, Mr. Cabada received the Lloyd Tevis Award for Excellence in Commercial Law and the Alumni Association Award for Outstanding Service. Mr. Cabada received his B.S. degree in Political Science, with high honors, from the University of California at Santa Barbara in 1997. Francisco served in the United States Marine Corps Reserve from 1992 to 2000, earning the rank of Sergeant.

Mr. Cabada is admitted to practice law in the state of California, including all the state courts, the United States District Court for the Central and Southern District of California and the United States Court of Appeals for the Ninth Circuit.

Representative Matters

Mr. Cabada’s experience includes:

  • Represented Univision Music against its former promotions director in action alleging wrongful termination for refusing to engage in the practice of payola. Advised Univision Music on parallel criminal investigation by the Department of Justice.
  • Represented prominent US subsidiary of Mexican beef importing company against claims of sex discrimination, retaliation In violation of California Whistleblower laws ( Labor Code section 1102.5), and wrongful termination in violation of public policy. Conducted an investigation of Plaintiff’s claims of accounting irregularities, which included interviewing Spanish speaking employees. Handled a pre-litigation mediation and subsequent settlement negotiations resulting in a favorable settlement for the Viz Cattle Corporation.
  • Represented Liquiddium Capital Partners, LLC, Sportfolio, Inc. and other related entities against former executive’s claims of breach of oral employment contracts, conversion, quantum meruit and waiting time penalties.
  • Defended various California employers in wage & hour class actions alleging overtime and meal and rest period violations.
  • Represented numerous employers against wrongful termination cases alleging violations of various employment laws including FEHA, Title VII, FMLA, ADA, etc.
  • Provided advice & training to various employers on a variety of areas, including AB 1825 training to Spanish-Speaking employees, alternative work schedules and California overtime laws.
  • Conducted numerous internal investigations involving allegations of criminal activity against company executives and employees.
  • Represented a partner of a Big Four accounting firm in connection with a criminal investigation by the U.S. Attorney’s Office into the marketing and sale of alleged tax shelters.
  • Represented former wife of the co-founder off Hard Rock Café, Peter Morton, in a high profile trial involving fraud and invasion of privacy.
  • Represented Gerber Products Company in defense of class and unfair competition claims on behalf of consumers alleging false advertising on product packaging. See, e.g., Williams v. Gerber Products Company, 439 F. Supp. 2d 1112 (S.D. Cal. 2006). Advised Gerber Products Company on regulatory matters, including FDAC regulations and applicable state laws.
  • Represented a leading software trade association in domestic and international disputes, including matters in U.S. state and federal courts, Mexican courts and international mediation.
  • Advised international internet gaming company on federal and state anti-gaming laws, including the Unlawful Internet Gambling Enforcement Act of 2006, the Wire Act and related state statutes.
